Terms of Service

1.1 Account Creation

• You must be at least 18 years old to create an account
• You must provide accurate, complete, and current information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access

1.2 Account Responsibilities

You are responsible for all activities that occur under your account. You may not use another user's account without permission. You agree to notify us immediately of any breach of security or unauthorized use of your account.

1.3 Professional Credentials

If you represent yourself as a BCBA, BCaBA, or RBT, you warrant that you hold valid, current certification from the BACB. We reserve the right to verify credentials and suspend accounts with false or expired certifications.

3.2 Payment Terms

• • Subscriptions are billed in advance on a monthly or annual basis
• • All fees are in US dollars and non-refundable except as required by law
• • Prices are subject to change with 30 days notice
• • You authorize us to charge your payment method for all fees
• • Failed payments may result in service suspension

3.3 Auto-Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel anytime through your account settings. Cancellation takes effect at the end of the current billing period.

3.4 Refund Policy

We offer a 14-day money-back guarantee for first-time subscribers. After 14 days, all payments are non-refundable. No refunds are provided for partial months, unused features, or account termination.

5.1 Your Content

You retain all rights to the content you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely for the purpose of providing the Service. This license ends when you delete your content or account, except where retention is required by law.

5.2 Data Accuracy

You are solely responsible for the accuracy, completeness, and legality of your supervision data. We do not verify the accuracy of logged hours or supervision activities. False or fraudulent data may be reported to the BACB.

5.3 PHI and Confidential Information

If you upload PHI or confidential client information, you must ensure proper authorization and de-identification unless covered by a BAA. You are responsible for compliance with HIPAA and other applicable privacy laws.

10.1 Termination by You

You may terminate your account at any time through account settings. Upon termination, your right to use the Service will immediately cease. Termination does not entitle you to any refunds.

10.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Request by law enforcement
• Extended periods of inactivity
• Technical or security issues

10.3 Effect of Termination

Upon termination, you have 30 days to export your data. After 30 days, we may delete your account and data, except as required for legal compliance or legitimate business purposes. Supervision records may be retained for 7 years as per BACB requirements.

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in [Your County, State].

11.2 Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. The arbitration shall be conducted in [Your City, State]. You waive any right to a jury trial or to participate in a class action.

12.1 Entire Agreement

These Terms constitute the entire agreement between you and ClassroomPulse, LLC (Supervision Hub) regarding the Service and supersede all prior agreements and understandings.

12.2 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

12.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

12.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

12.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
